Richard Leo PhD, JD of USF Law
Why do people confess to crimes they did not commit? Dr Leo told of instances where lawyers are not present during questioning; where police can make false claims about incriminating evidence; where police misinterpret body language; where confession seems like the safest, easiest way out of the problem. If police then tell the suspect non-public details of the crime, that can make later discussions even more incriminating.
The police are faced with trying to find the guilty person. Newer technology so far is not helpful, particularly voice stress analysis which is like a new version of the lie detector test.
Digital recording of all interrogations could help to protect both police and suspects. In California only homicide cases are recorded; juveniles have additional protections.
